MINUTES OF THE JUNE 12, 2013 MEETING

TRUSTEES PRESENT: Michael Carey, Charles Casella, Robert Coffey
TRUSTEES ABSENT: Laila Mandour

OTHERS PRESENT: Brenda Halpin, Director - Retirement Services Division and Virginia Brown, Division Counsel - Retirement Services Division

The meeting began at approximately 2:20 p.m.

The Subcommittee continued the discussion on the Proposed SERS and CMERS Overpayments Processes and Procedures and completed the review with minor revisions.
Requests for Waiver of Overpayments

Shirlene Lewis (SERS) - member - Tabled from November 2012 meeting
Overpayment due to agency error
Action: Mr. Casella moved; Mr. Coffey seconded to recommend denial of the waiver request. All voted in favor. Unanimous decision.

Lorraine Montesi (SERS) - member - Tabled from April 2012 meeting
Overpayment due to administrative error
Action: Mr. Carey moved; Mr. Coffey seconded to recommend denial of the waiver request. All voted in favor. Unanimous decision.

Dorothy Donar (CMERS) - annuitant
Overpayment due to administrative error
Action: Mr. Carey moved; Mr. Cassella seconded to recommend the case be dismissed because of the statute of limitations and no availability to collect from the estate. The case should be administratively closed. All voted in favor. Unanimous decision.

Richard Lemke (CMERS) - member
Overpayment due to receipt of Social Security Disability
Action: Mr. Carey moved; Mr. Casella seconded to recommend reinstatement of the $303.10 repayment plan. All voted in favor. Unanimous decision.

Action: Mr. Coffey moved; Mr. Carey seconded to recommend denial of the waiver request. All voted in favor. Unanimous decision.

Arthur and Elisse Jirau (CMERS) - annuitants
Overpayment due to administrative error based on payment to Mrs. Krumeich's estate
Action: Mr. Carey moved; Mr. Coffey seconded to administratively close the case and not to pursue the overpayment from the estate through the Attorney General'S Office. All voted in favor. Unanimous decision.
