MINUTES OF February 1, 2016 MEETING

The meeting began at 2:37 p.m.

The Subcommittee discussed the following claims that had been administratively denied by the Retirement Services Division. All of the recommendations are unanimous unless noted accordingly.

Gladys Ayala - Request received from Ms. Ayala that the Retirement Services Division accept the representation made by her former employing agency in 1993 that she was vested with 10 years of state service and eligible for a future retirement benefit.

Action: Mr. Casella moved, seconded by Ms. Brown-Brewton to recommend approval of Ms. Ayala's request as long as a purchase of prior state service is completed.

Tim Bombard - Request received from Mr. Bombard that the Division give an exemption to allow him to apply to grandfather his normal retirement date beyond the application acceptance deadline date of March 3, 2014.

Action: Mr. Casella moved, seconded by Ms. Brown-Brewton to recommend denial of Mr. Bombard's request for an exemption to make application to grandfather his normal retirement date.

Michael Brunetto - Request received by Mr. Brunetto to change his retirement income payment election following the commencement of his retirement benefit.

Action: Ms. Brown-Brewton moved, seconded by Mr. Coffey to recommend denial of Mr. Brunetto's request to change his retirement payment income election following the commencement of the benefit.

Barbara Carbino - Request received from the children of Barbara Carbino that following her death as an active employee that a posthumous benefit is calculated under either the ten or twenty year period certain retirement income option.

Action: Ms. Brown-Brewton moved, seconded by Mr. Casella to recommend denial of the request that following Ms. Carbino's death that a posthumous benefit is calculated. under either the ten or twenty year period certain retirement income option.

Sheila Colson - Request received from Sheila Colson that the Retirement Commission review the denials of her application for service connected disability by the Medical Examining Board and determine to afford her another opportunity to receive a service connected disability.

Action: Mr. Cassella moved, seconded by Mr. Coffey to recommend denial of the Ms. Colson's request to afford her another opportunity to receive a service connected disability.

Gail Crockett - Request received from Gail Crockett that she be allowed to purchase two periods of sick leave that occurred during her service from August 1978 to December 1988 thereby allowing her to retain retirement plan membership in Tier I.

Action: Ms. Brown-Brewton moved, seconded by Mr. Casella to recommend approval of Ms. Crockett's request to purchase two periods of sick leave to retain her membership in SERS Tier I, Plan B.

Charles Daly - Request received from Charles Daly that he disagrees with the Division's interpretation of "rate of salary" and as such, his service connected disability retirement benefit from SERS should be recalculated.

Action: Ms. Brown-Brewton moved, seconded by Mr. Casella to recommend denial of the request by Mr. Daly.

Robert Dul - Request received from Mr. Dul for a change in his retirement income payment election following the commencement of benefit payments.

Action: Ms. Brown -Brewton moved, seconded by Mr. McLellan to recommend denial of Mr. Dul's request to change his retirement income payment election following his receipt of benefit payments.

Mary Fassio - Request received from Mary Fassio that the Retirement Commission review the Medical Examining Board (MEB) denials of her application for a non-service connected disability and afford her another opportunity to go before the MEB for consideration.

Action: Ms. Brown-Brewton moved, seconded by Mr. Casella to recommended denial of Ms. Fassio's request that her application for non- service connected disability retirement go back before the MEB for consideration.

Gail Fay - Request received from Gail Fay that the Medical Examining Board (MEB) denials of her application for service connected disability be reviewed by the Retirement Commission and that she be afforded another opportunity for her application to go back before the MEB for consideration.

Action: Ms. Brown-Brewton moved, seconded by Mr. Casella to recommend denial of Ms. Fay's request that her application for service connected disability go back before the MEB for consideration.

Jeffrey LaPorto - Request received on behalf of Mr. LaPorto that the Retirement Commission review the Medical Examining Board (MEB) denials of his application for disability retirement and afford him another opportunity for his application to go back before the MEB for consideration.

Action: Ms. Brown-Brewton moved, seconded by Mr. Casella to recommend denial of the request made on Mr. LaPorto's behalf that his application for disability retirement go back before the MEB for consideration.

Louis Luba - Request received from Louis Luba that he be afforded the opportunity to "grandfather his retirement date" beyond the deadline associated with this opportunity.

Action: Mr. Casella moved, seconded by Mr. McLellan to recommend approval of Mr. Luba's late request to "grandfather his retirement date".

Cathy McCrackan - Request received from Cathy McCrackan that the Retirement Commission allow her late request to purchase retirement credit for her prior military service.

Action: Ms. Brown-Brewton moved, seconded by Mr. Coffey to recommend denial of Ms. McCrackan's request to purchase retirement credit for her prior military service.

Charles Urso - Request received from Mr. Urso that for the purposes of calculating a member's average salary a period of ten months of service can be defined as a "year of state service".

Action: Mr. McLellan moved, seconded by Ms. Brown-Brewton recommended denial of Mr. Urso's request of defining a period of ten months of service as a "year of state service".
