The Chair called the meeting to order at 8:37 a.m.

At 8:37 a.m., Charles Casella moved, seconded by Michael Carey to approve the agenda.  All voted in favor.

At 8:38 a.m., Chairman Adomeit called for new business. 

Mr. Casella discussed a matter that came before the overpayments subcommittee, and the fact that the overpayment at issue was made more than six years ago.  Mr. Casella inquired whether there was a limitations period with respect to the Commission’s ability to seek to recover overpayments.  Chairman Adomeit assigned the matter to Commission Counsel and Commission Tax Counsel to prepare a legal opinion with respect to any limitation on the Commission to seek to recover an overpayment.

At 8:42 a.m., Charles Casella moved, seconded by Michael Carey, to enter into executive session for the purpose of discussing item nos. 1-20 on the agenda for executive session.  All voted in favor.  Attorneys Rose, Cieslak, Barth and Sullivan were invited into executive session.

At 10:43a.m., Charles Casella moved, seconded by Michael Carey, to come out of executive session. All voted in favor. 

No recommendations were made regarding matters discussed in executive session.

At 10:43 a.m., Chairman Adomeit asked if there was any old business to discuss.  The Subcommittee requested an update from the Retirement Services Division regarding the CMERS annual surveys regarding reemployment. 

The Subcommittee also discussed the upcoming RFPs for Commission Counsel and Commission Tax Counsel.  Chairman Adomeit advised that he would contact Attorney Braswell to begin the process and will include it in his Chairman’s report to the Commission. 

MEETING ADJOURNED:  At 10:48 a.m., Michael Carey moved, seconded by Charles Casella, to adjourn.  All voted in favor.  Meeting adjourned.
