MINUTES OF MEETING

October 12, 2016

The Chair called the meeting to order at 8:30 a.m. and asked the members to consider Item II on the agenda, the approval of the agenda.

Mr. Casella moved, seconded by Mr. Carey to approve the agenda. All voted in favor.
Under Item III New Business Public Session, the subcommittee received an update on the Kathryn Miller matter. No action was taken.

Mr. Casella moved, seconded by Mr. Carey to go into Executive Session to consider written legal opinions concerning the Leff purchase of service, the CMERS overpayments analysis, CGS Section 5-192b(c) interpretation and IRS limitations on pension calculations and pending litigation in the following matters: Bouchard, Brown, Maturo, Walenski, and UPSEU v. Town of Thompson and to invite Attorney Barth and Attorney Cieslak to participate in the discussions. All voted in favor.

Mr. Carey moved, seconded by Mr. Casella to come out of Executive Session. All voted in favor.

Mr. Casella moved, seconded by Mr. Carey to amend the agenda for the Executive Session portion of the meeting to include updates on the Carter, Carver, and Krawiec matters. All voted in favor.

Mr. Carey moved, seconded by Mr. Casella to go into Executive Session to receive updates on the Carter, Carver, and Krawiec matters and to invite Attorney Cieslak and Attorney Barth to participate in the discussions. All voted in favor.

Mr. Carey moved, seconded by Mr. Casella to come out of Executive Session. All voted in favor.

Mr. Carey moved, seconded by Mr. Casella that the subcommittee recommend to the Commission that it direct the Division to seek recoupment from Bernadette Baldino of CMERS pension payments made for January and February, 2016. All voted in favor.

Mr. Carey moved, seconded by Mr. Casella that the subcommittee recommend to the Commission that it direct the Division to recover all 2016 CMERS pension payments from the following: Ann Crespo, Richard Belden, Halina Fajer-Wolczacki, Betsy Mauri, Judith Nagle, Kim Walton, John Harkins III, Lance Helms, Cheryl Maturah, Hector Ramos, Sara Seney, Timothy Webb, and Charles Leavens. All voted in favor.

Mr. Carey moved, seconded by Mr. Casella to go into Executive Session to discuss IRS limitations on pension calculations and to invite Attorney Barth and Attorney Cieslak to participate in the discussions. All voted in favor.

Mr. Carey moved, seconded by Mr. Casella to come out of Executive Session. All voted in favor.

Mr. Carey moved, seconded by Mr. Casella to amend the Public Session portion of the agenda to discuss the SAG award. All voted in favor. Following the discussion, no action was taken.
Mr. Casella moved, seconded by Mr. Carey to go into Executive Session to discuss IRS limitations on pension calculations and to invite Attorney Barth and Attorney Cieslak to participate in the discussion. All voted in favor.

At 11:18 a.m., Mr. Carey exited the meeting.

Mr. Casella moved, seconded by Mr. Coffey to come out of Executive Session. All voted in favor.

Mr. Casella moved, seconded by Mr. Coffey to adjourn. All voted in favor. The meeting adjourned at 11:37 a.m.
