MINUTES OF MEETING

June 9, 2016

The Chair called the meeting to order at 8:35 a.m. and asked the members to consider Item II on the agenda, the approval of the agenda.

Mr. Carey moved, seconded by Mr. Coffey to approve the agenda for the meeting. All voted in favor.

Mr. Casella moved, seconded by Mr. Coffey to go into Executive Session to discuss the following agenda items: Brown, Maturo, and Carver and to invite Attorneys Rose, Barth and Cieslak to participate in the discussions. All voted in favor.

At 9:00 a.m., following the discussion of these items, Mr. Carey moved, seconded by Mr. Casella to come out of Executive Session. All voted in favor.

Mr. Coffey moved, seconded by Mr. Carey to hold due process hearings in the matters of MERS retirees Ana Crespo and Nadya Serrano. All voted in favor.

At 9:02 a.m. Ms. Crespo gave testimony and responded to questions in the matter of whether her retirement benefits should be suspended in accordance with the statutes due to her employment.

At 9:17 a.m. Ms. Serrano gave testimony and responded to questions in the matter of whether her retirement benefits should be suspended in accordance with the statutes due to her employment. Ms. Serrano testified that she resigned from her employment with the town of Windsor.
The hearings were recorded and transcripts were ordered.

At 9:27 a.m., Mr. Coffey moved, seconded by Mr. Carey to go into Executive Session to discuss the following agenda items: CGS Section 7-438(b) interpretation inquiry written legal opinion, Whitman, Etim, Crandle, Lifetime Option Spousal Waiver Inquiry written legal opinion, and Diaz and to invite Attorneys Rose, Barth and Cieslak to participate in the discussions. All voted in favor.

At 10:54 a.m., Mr. Coffey moved, seconded by Mr. Casella to come out of Executive Session. All voted in favor.

At 10:55 a.m., Mr. Carey moved, seconded by Mr. Casella to recommend to the Commission that it suspend MERS pension payments to Ana Crespo by a letter to be drafted by Commission Counsel. All voted in favor. No motions were made regarding the items discussed in the Executive Session.

Under Old Business, the subcommittee received an update from Attorney Barth on efforts to obtain information concerning the calculation methods used by the Retirement Division to ensure compliance with IRC Section 415.

At 11:07 a.m., Mr. Carey moved, seconded by Mr. Casella to adjourn. All voted in favor. The meeting adjourned.
