MINUTES OF MEETING

July 13, 2016

The Chair called the meeting to order at 8:30 a.m. and asked the members to consider Item II on the agenda, the approval of the agenda.

Mr. Casella moved, seconded by Mr. Carey to approve the agenda for the meeting. All voted in favor.

The first agenda item under New Business in Public Session was the Status of the 2016 MERS surveys. Following discussion, Attorney Rose stated that he would prepare briefing sheets on each retiree who required action as a result of the survey for consideration at the August 10 meeting of the subcommittee.

At 8:50 a.m. the subcommittee received an update on the Kathryn Miller matter. There was consensus that this matter should be placed on the Commission agenda for a second day of hearing. An evidentiary hearing was held on February 18, 2016 which did not conclude.

At 9:07 a.m. the subcommittee received an update on the Gary Soracchi matter.

At 9:10 a.m. Mr. Carey moved, seconded by Mr. Casella, to amend the agenda to include a discussion in Executive Session of a written legal opinion in the Soracchi matter. All voted in favor.

At 9:11 a.m., Mr. Carey moved, seconded by Mr. Casella to go into Executive Session on the following matters: Gary Soracchi, Lilly Phillips, Bouchard, Brown, Maturo, Whitman, Carver, Etim, Pine, and Walenski, and to invite Attorney Rose and Attorney Barth to participate in the discussions. All voted in favor.

At 9:18, a.m. Mr. Coffey left the meeting.

At 9:54 a.m. Mr. Carey moved, seconded by Mr. Casella to come out of Executive Session. All voted in favor. No motions were made in the Public Session concerning the matters discussed in the Executive Session.

At 9:55 a.m. Mr. Casella moved, seconded by Mr. Carey to go into Executive Session to discuss a written legal opinion from Robinson and Cole on IRS matters. All voted in favor.

At 10:31 a.m. Mr. Carey moved, seconded by Mr. Casella, to come out of Executive Session. All voted in favor. No motions were made in the Public Session concerning the matters discussed in the Executive Session.

At 10:32 a.m. Mr. Carey moved, seconded by Mr. Casella to adjourn. All voted in favor. The meeting adjourned.
