MINUTES OF MEETING

MEETING CALLED TO ORDER. At 8:38 a.m. Chairman Adomeit called the meeting to order, with the following individuals present: Chairman Peter Adomeit; Trustee Michael Carey; Trustee Charles Casella; Commission Counsel Michael Rose (FordHarrison, LLP); Commission Counsel Cindy Cieslak (FordHarrison, LLP); and Commission Tax Counsel Alisha Sullivan (Robinson & Cole).

At 8:38 a.m., Charles Casella moved to approve the agenda. The motion was seconded by Michael Carey. All in favor.

At 8:39 a.m., Chairman Adomeit presented the Chairman?s Report. Chairman Adomeit reported that he has been meeting with state legislators concerning the Commission?s proposed bill regarding an amendment to Conn. Gen. Stat. ? 7-438. Chairman Adomeit also reported that he met with Karen Buffkin from the Governor?s office. Chairman Adomeit has a few additional meetings with other state legislators scheduled for later this month, and he is hopeful that the Labor Committee will sponsor the bill.

At 8:40 a.m., Attorney Virginia McGarrity entered the meeting.

At 8:48 a.m., Charles Casella moved to enter into executive session for the purpose of discussing item nos. 1-12 on the agenda for executive session. Michael Carey seconded the motion. All in favor. Attorneys Rose, Cieslak, Sullivan and McGarrity were invited into executive session.

EXECUTIVE SESSION

  1. Federal Regulation of State & Local Governmental Retirement Plans - written legal opinion - discussion.
  2. IRC Section 415(b)(5) Phase-In Reductions Applicable to Participants with Less than Ten Years of Service - written legal opinion - discussion

  4. MEB meetings - written legal opinion - update.
  5. Carter - pending claim - update.
  6. Lilly Phillips - pending claim - update.
  7. Colson - written legal opinion - update.
  8. Walenski - pending litigation - update.
  9. Thompson - pending litigation - update.
  10. Krawiec - pending litigation - update.
  11. Bouchard - pending litigation - update.
  12. Maturo - pending litigation - update.

No motions were taken in executive session.

At 9:30 a.m., Charles Casella moved to come out of executive session so that the Subcommittee can receive an update from the Attorney General?s office regarding the SEBAC v. Rowland settlement, which was scheduled for 9:30 a.m. The motion was seconded by Michael Carey. All in favor.

A break was taken from 9:30 a.m. to 9:35 a.m.

PUBLIC SESSION

At 9:35 a.m., Peggy Chapple (Attorney General?s office), Alayna Stone (Attorney General?s Office), Karen Haabestad (Attorney General?s Office), Beth Margulies (Attorney General?s Office), and Eleanor Mullen (Attorney General?s Office) entered the meeting.

Attorney Chapple provided an update as to the settlement reached in SEBAC v. Rowland and discussed settlement calculation issues as they pertain to retirement.

A break was taken from 10:04 a.m. to 10:14 a.m.

At 10:14 a.m. Charles Casella moved to re-enter executive session for the purpose of discussing the items scheduled for executive session (above) that had not yet been discussed. Michael Carey seconded the motion. All in favor. Attorneys Rose, Cieslak, Sullivan and McGarrity were invited into executive session.

No motions were taken in executive session.

At 11:09 a.m. Charles Casella moved to come out of executive session. Michael Carey seconded the motion. All in favor.

At 11:09 a.m. Chairman Adomeit asked if there was any old business to discuss. No old business was raised.

MEETING ADJOURNED: At 11:09 a.m. Charles Casella moved, and Michael Carey seconded to adjourn. All in favor. Meeting adjourned.
