TO THE HEADS OF ALL STATE AGENCIES

Attention: Chief Administrative and Fiscal Officers, Business Managers, and Payroll and Personnel Officers
Subject: Payroll Procedures for Laid-off Employees Returning to State Service

I. PURPOSE

The purpose of this memorandum is to provide agencies with correct payroll procedures for employees returning to state service.

II. PROCEDURES

Agencies are to adhere to the following procedures when returning a laid-off employee to State service. A laid-off State employee rehired in the same year should be treated as a transferring employee.

  1. The employing agency will notify the former agency that they have hired the employee and request screen prints from MSA screens 160-170.
  2. The Employee Transfer/Number Correction, CO-1008 form, is to be completed by the employee's former agency and sent to the Office of the State Comptroller, Payroll Services Division. Please follow the dates on the Biweekly Payroll Schedule for transfer dates, to ensure the employee is paid on time.
  3. The new agency will make the appropriate accounting changes after the transfer is complete.

III. VACATION TIME

Employees are allowed to purchase back the vacation time they received as a lump sum payment at the time of layoff. A written election is required no later than one week after reinstatement from layoff. The election form is to be submitted to the agency's personnel office and maintained in the employee's personnel file.

The agency must notify the employee of the amount due and once received, deposit the employee's check for repayment. A completed COP-9 form showing the adjustment to the employee's wages is then sent to the Comptroller's Payroll Services Division.

IV. BENEFITS

Procedures for the administration of benefits, health, life, supplemental deferred compensation, 403(b), etc, will be issued at a later date from the Retirement and Benefits Services Division.
