At 10:02 a.m. Mr. Baus moved to discuss the letter from Deputy Chief State's Attorney Leonard Boyle concerning United States v. Raymond LaChance, Docket No. 8:14 - CR-118-T-30TGW, seconded by Ms. Yelmini.

After careful consideration of the facts as known, the Retirement Trustees concur with the advisement of Deputy Chief State's Attorney Boyle to forgo the prosecution in the State of Connecticut with the following understanding:
  

• that the Connecticut division of Criminal Justice will not initiate charges against Raymond LaChance regarding his theft in question of  $182,832.55;
• that the aforementioned amount of loss incurred by the Commission will be included as "relevant conduct" in the calculation of Raymond LaChances sentencing guildlines;
• that a restitution order in the aforementioned amount with applicable interest, if possible, be entered in favor of the Commission against Raymond LaChance at the time of          sentencing;
• that Raymond LaChance agrees that he will not appeal or otherwise seek collateral relief from the restitution order in question.

All voted in favor.

At 10:18 a.m. Mr. Casella moved, seconded by Mr. Luciano to adjourn.
