SUBCOMMITTEE ON PERSONNEL AND LEGAL MATTERS

MINUTES FOR MEETING RESCHEDULED FROM AUGUST 3, 2011

The meeting began at approximately 1:05 p.m. A motion was made by Mr. Casella, second by Mr. Coffey to go into executive session to discuss an RFP to secure counsel to provide pension/tax advice to the State Employees Retirement Commission and the Office of the State Comptroller and also on-going legal issues with regard to litigation relating to the Longley case and the extension of a contract held with the law firm of Rose-Kallor. Division personnel and Attorney Rubin whose office (AGO) issued the contract were invited to stay. Unanimous decision.

Attorney Rubin left the meeting at approximately 2:00 p.m.

Mr. Coffey moved, seconded by Mr. Casella to come out of executive session at approximately 2: 55 p.m. Unanimous decision.

Mr. Casella made the following motion: that Division Counsel pursue the Rose-Kallor contract amendment with the necessary parties. Mr. Coffey seconded the motion. Unanimous decision.

Mr. Carey made the following motion with regard to the RFP for tax/pension legal services: that Division Counsel follow up on the issues and questions discussed in executive session; that she draft and submit to the subcommittee a suggested scope of services and firm qualifications in accordance with the discussion and that she take the necessary steps to continue work on the RFP. Mr. Coffey seconded the motion. Unanimous decision.

The subcommittee decided to meet again in two weeks to continue work on the RFP process.

Mr. Coffey moved to adjourn the meeting at 3:00 p.m. Mr. Carey second. Unanimous decision.
