MEMORANDUM NO. 95-45

TO THE HEADS OF ALL STATE AGENCIES

ATTENTION:Chief Administrative Officers and Fiscal Officers, Business Managers, and Payroll and Personnel Officers
SUBJECT: Revised Workweek and Payment of Overtime for Managerial and Confidential Employees
  1. AUTHORITY

    In accordance with a DAS/OLR Memorandum No. 95-67/OLR-21, there will be an increase in the normal workweek for the above mentioned employees effective July 1, 1995.

  2. ARTICLE 16 - HOURS OF WORK

    1. Section One

      Effective July 1, 1995 and each July 1 thereafter through July 1, 1998, the standard workweek will be increased by one hour and fifteen minutes (1:15) until the standard workweek reaches forty (40) hours per week, commencing July 1, 1998.

      Effective July 1, 1995 and each subsequent July 1 through July 1, 1998, schedules which vary from the standard workweek will be increased as set forth above.

      These increases will take place for all full-time executive branch employees in the MP, MD, ME pay plans and also to all employees designated as confidential regardless of the bargaining unit from which they have been excluded, except for unclassified employees of any of the boards of trustees of the constituent units of higher education.

    2. Implementation of the change in hours worked will require the following:

      • The change in time accruals will occur between pay periods. Agency staff must calculate the base pay amount each year of the contract for the first pay period in July.

    3. Pay Period beginning June 23, 1995, ending July 6, 1995

      From June 23, 1995 through June 30, 1995 the work day is seven hours. Effective July 1, 1995 the seven and one-quarter hour work day begins.

    4. Calculation of Accruals after July 1, 1995

      Future leave accruals will be based upon the longer workweek.

  3. AGENCY HEADS AND OTHER APPOINTED OFFICIALS

    Those managerial and confidential employees who are assigned to the EX pay plan are assigned to a 40-hour workweek effective immediately. Leave will be accrued based on an 8-hour day. There will be no further salary adjustment. Payroll procedures will be issued separately to those agencies administering this pay plan.

  4. OVERTIME FOR MANAGERIAL AND CONFIDENTIAL EXCLUSIONS

    Overtime should be paid to managerial and confidential employees who earn up to the following annual base salary:

Agencies should use the base salary amount that the employees are earning on the effective date.

    1. Changes to Hours of Standard Work Week

      1. First Pay Period of Contract Year

        1. Agency payroll staff must calculate and manually adjust the master file for the change in hours worked and new base pay amount to reflect the additional hours worked for employees with a Monday to Friday work schedule as follows:

    * The new standard work week of 80 hours bi-weekly will begin the second pay period of July 3 through July 16, 1998 (check date July 31, 1998).

    1. The hours worked times the rate of pay will be the base pay amount for the first pay period in the contract year. Since July 1, 1995 is not the first day of a pay period, salary payments for the period (6/23/95 through 7/6/95) should be processed as follows:

      A ZT transaction showing the hours worked from 6/23/95 through 7/6/95 Note: This transaction should also override Auto Pay if necessary -- place a "#" in the OR CD field.

    1. Second Pay Period of Contract Year

    1. For the pay period July 7, 1995 through July 20, 1995 check date August 4, 1995, the hours worked must be manually input on Screen 160. Change Normal Hours to 72.50 and Normal Salary to the salary from the new pay plan or as directed by the Department of Administrative Services. Each subsequent year this adjustment must be made to reflect the new base hours and bi-weekly salary as follows:
