TO STATE COLLEGES, UNIVERSITIES, AND AGENCIES WITH EMPLOYEES ELIGIBLE TO PARTICIPATE IN 403(B) PLAN

Attention:    Personnel and Payroll Officers, Chief Administrative and Fiscal Officers, Business Managers
Subject:    IRS Notice of Compliance Check

This memo is directed to all state colleges, universities and agencies whose employees may be eligible to participate in the State of Connecticut 403(b) Plan.

The Internal Revenue Service (IRS) has initiated compliance checks for a random sample of over 300 large, medium, and small public and private higher education organizations sponsoring 403(b) plans. The information request includes a 21-item questionnaire (Form 886-A, "Explanation of Items, Section 403(b) for Higher Education"), which must be returned within 25 days from the date of the letter.

The following agencies have employees who may be entitled to participate in the 403(b) Plan: University of Connecticut, University of Connecticut Health Center; State Universities, including the Board of Trustees; Community-Technical Colleges, including the Board of Trustees; Department of Higher Education; Department of Education, including the Vocational-Technical High Schools; Department of Correction, Unified School District No.1; Department of Children and Families, Unified School District No. 2 and Riverview Hospital; Department of Mental Retardation, Unified School District No. 3, Board of Academic Awards and Department of Mental Health and Addiction Services, Connecticut Valley Hospital, Cedarcrest Hospital, Greater Bridgeport Community Mental Health Center and CT Mental Health Center.

We have already received an IRS compliance check on behalf of the University of Connecticut. As the agency responsible for the day to day administration of the 403(b) Plan, the Comptroller"s Office will be responding to the inquiry.

If your agency should receive an IRS notice of a compliance check regarding the 403(b) Plan, please forward all materials to Margaret E. Haering, Division Counsel immediately.
